1. Acceptance of Terms
By accessing or using this website, requesting a quote, signing an agreement, or purchasing services from HTX Roofing & Exteriors LLC (“HTX,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not use this website or engage HTX for services.
2. Services Provided
HTX provides roofing and exterior services, including inspection, repair, replacement, and insurance claim assistance for residential and commercial properties in the state of Texas. Service availability and scope may vary based on safety conditions, weather, material availability, local regulations, and job complexity.
3. Estimates, Pricing & Scope
- All written estimates are generally valid for 30 days unless otherwise stated.
- Pricing may change due to hidden damage, structural differences, material changes, manufacturer pricing, or local building code requirements.
- Final pricing is confirmed in a signed Work Agreement or Contract before scheduling and ordering materials.
- For insurance claim projects, estimates and scope are subject to insurance carrier approval and may require supplemental documentation or adjustments.
4. Payment Terms
Payment terms (amounts, due dates, and schedule) are specified in each signed Work Agreement or Contract. A Production Hold Payment(deposit) may be required to secure your project on our production calendar and to allocate labor and resources.
Final payment is due upon substantial completion of work, unless other arrangements are set out in writing in the contract.
4.1 Non-Payment & Legal Remedies
If payment is not made in accordance with the signed agreement, HTX Roofing & Exteriors LLC reserves the right to take one or more of the following actions:
- Assess late fees and/or reasonable collection charges.
- Suspend or stop work until payment is brought current.
- Pursue collection through a third-party collections agency or legal action.
- File a mechanic’s lien on the property under Texas Property Code §53.
4.2 Repossession of Materials
HTX retains ownership of all materials provided for the project, whether delivered or installed, until payment has been made in full in accordance with the contract.
- If the payee fails to pay in full, HTX may repossess and remove any materials, including but not limited to shingles, underlayment, accessories, ventilation components, and specialty items, that have not been fully paid for.
- Repossession may include accessing the property to remove materials, subject to applicable law and the terms of the contract.
- Removal of materials may result in exposed decking or unfinished areas; HTX is not responsible for any resulting exposure, damage, or conditions caused by homeowner non-payment.
5. Refund & Cancellation Policy
5.1 Cancellation Before Contract Signing
- No fees are charged if the homeowner cancels before signing a contract.
- No materials will be ordered prior to a signed contract.
5.2 Cancellation After Contract Signing (Before Materials Are Ordered)
- Upon signing the contract, the Production Hold Payment becomes non-refundable.
- If the homeowner cancels after contract signing but before materials are ordered, the Production Hold Payment is forfeited in full.
5.3 Cancellation After Materials Are Ordered
- If cancellation occurs after materials have been ordered, the customer is responsible for:
- Forfeiture of the Production Hold Payment;
- Any material restocking fees charged by suppliers (if applicable);
- Full payment for any custom or non-returnable materials that cannot be returned or reused.
5.4 Cancellation After Work Has Begun
- If the homeowner cancels after labor or installation has begun, the customer is responsible for:
- Forfeiture of the Production Hold Payment;
- Full payment for all delivered and/or installed materials;
- Labor charges proportional to the percentage of work completed;
- Any additional labor or disposal costs associated with partial removal or job stoppage.
5.5 Insurance Claim Cancellations
- For insurance claim projects, the homeowner remains responsible for any deductible amounts in accordance with Texas law. Deductibles cannot be waived.
- If a contract has been signed, the Production Hold Payment remains non-refundable.
- If materials were ordered or labor started based on carrier approval, Sections 5.3 and 5.4 above apply.
6. Lifetime Workmanship Warranty (Residential Installations)
For qualifying full roof replacements on owner-occupied residential properties, HTX offers a Lifetime Workmanship Warranty on workmanship, for the lifetime of the roofing system as defined by the manufacturer’s stated life expectancy at the time of installation, so long as the original homeowner owns and occupies the home.
6.1 What This Warranty Covers
- Workmanship errors in the installation performed by HTX.
- Issues related to improper installation of shingles, underlayment, flashing, fasteners, and roof ventilation components that are part of the original HTX-installed roofing system.
- Labor required to correct covered workmanship defects.
6.2 What This Warranty Does Not Cover
- Damage caused by storms, hail, wind, tornadoes, hurricanes, floods, ice dams, or other acts of God.
- Damage caused by animals, tree limbs, impact, or third-party contractors (solar installers, painters, gutter installers, satellite installers, etc.).
- Material defects, discoloration, or product failure (these may be covered under the manufacturer’s product warranty, not HTX’s workmanship warranty).
- Pre-existing leaks, rot, mold, structural issues, or hidden substrate conditions discovered during or after installation.
- Foot traffic damage from the homeowner or other contractors.
6.3 Homeowner Responsibilities
- Notify HTX in a timely manner if a potential roofing issue or leak is discovered.
- Allow HTX the first right to inspect and repair any claimed workmanship issue before hiring others. Failure to do so may void the warranty.
- Maintain reasonable care of the roof, including removing debris from valleys and gutters, and addressing pest or vegetation issues.
- Maintain proper attic ventilation; blocking, altering, or removing ventilation in a way that harms roof performance may void the warranty.
6.4 Warranty Transfer
- This warranty may be transferred one time to a subsequent homeowner.
- A $299 transfer fee and inspection are required.
- The transfer must be requested within 60 days of property closing.
- The roof system must remain substantially unchanged from HTX’s original installation.
6.5 Limitations
HTX’s obligation under this warranty is limited solely to the repair of workmanship-related defects. HTX is not responsible for interior damage, personal property damage, or consequential damages arising from leaks, events outside HTX’s control, or conditions excluded above.
7. Insurance Claim Assistance
HTX may assist homeowners with documentation and communication related to insurance claims; however:
- HTX is not an insurance adjuster and does not interpret coverage or policy language.
- HTX does not negotiate final claim payouts on behalf of the homeowner.
- The homeowner is responsible for paying their deductible; HTX does not and cannot waive deductibles in compliance with Texas Insurance Code.

They do not constitute legal, financial, engineering, or insurance advice, and they do not serve as a binding quote or guarantee of pricing or outcome. Actual project costs and scope are determined by an in-person assessment and a signed contract.
9. Intellectual Property
All text, logos, graphics, images, videos, and other content on this website are the property of HTX Roofing & Exteriors LLC or used with permission. You may not copy, reproduce, modify, distribute, or publicly display any content from this site without our prior written consent.
10. Limitation of Liability
To the fullest extent permitted by law, HTX Roofing & Exteriors LLC is not liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of this website or the services provided, even if advised of the possibility of such damages. In all cases, HTX’s total liability shall not exceed the total amount paid by the customer under the applicable Work Agreement or Contract.
11. Changes to These Terms
HTX may update or modify these Terms of Service from time to time. Any changes will be posted on this page with an updated “Last Updated” date. Your continued use of the website or services after such changes constitutes your acceptance of the revised Terms.
